A 21-year-old man charged with dangerous driving that caused the deaths of Shiva Devine and Conal McAleer is to be sent forward for trial.

Joseph Gilroy of 269 of Lisnaskea Road, Trasna Island, Lisnaskea, Co Fermanagh was before Donegal District Court on Monday. The charge also includes causing serious bodily harm to Rachel Elliot. It arose from a car crash at East End, Bundoran on August 19, 2018.  

Gilroy was represented in court by solicitor Tom McSharry.

Sergeant Oliver Devaney handed evidence of the arrest, charge and caution in to the court.

He said that the Director of Public Prosecutions (DPP) instructed trial by indictment in the circuit court.


The sergeant then asked that it be made a bail condition that Gilroy did not interfere in any way with the families involved or with any witness.

Judge Kilrane asked: “What about travel restrictions or surrender of passport?”

Sergeant Devaney replied: “He has co-operated and he has come here today from Northern Ireland.”

The case was adjourned to June 21 when the book of evidence is due to be served..

Gilroy was remanded on bail of €500 cash as per the condition put forward by Sergeant Devaney.
